3. Rex. v Lahmeyer/Lahmeyer MacDonald Consortium
Lahmeyer was charged of bribery of Mr Sole. It used the services of one Mr Du Plooy to transfer funds to Mr Sole.
Lahmeyer was found guilty and sentenced to payment of a fine by the High court. The fine was for an amount of 10 Million Maloti. Lahmeyer noted an appeal against conviction. There was also a cross Appeal by the crown on conviction and sentence.
The Appeal against conviction on some counts was dismissed and allowed on count 2, the Cross Appeal succeeded on counts 3 and 5 and failed on other counts.
The sentence imposed by the Court of Appeal was for payment of a fine of 12 million Maloti.
4. Rex V Du Plooy
Mr Du Plooy was charged with bribery of Mr Sole, it being alleged that he was used by various companies as a go-between to transfer funds intended to bribe Mr Sole.
He pleaded guilty to the charge and the High Court sentenced him to payment of a fine of M500,000.00 which is payable in three (3) equal instalments. The crown may use him as a witness in other cases where he acted as agent.
