APPROVED REFINEMENTS ON THE COMPENSATION POLICY

 

All refinements are in Italics in English, and the meaning has been translated into Sesotho –bold/italics

 

Definitions- /Lithlakiso

 

A vulnerable Household is the one that at the date of resettlement, for whatever reasons, has a lower than average capacity to recover its former standard of living and quality of life as a result of the impacts of LHWP.

Sec 11.4          Compensation for Gardens/ Mats’eliso a Majarete

 

1)                  Where LHDA acquires garden land it shall ensure that the replacement residential site includes a cultivable area of equivalent area or equal in productive value to that of the previous garden. LHDA shall in any case provide a minimum of 300-sqm.of garden land for each resettled household.

2)                  If suitable garden land at the new site cannot be found LHDA shall investigate the feasibility of creating gardens by earthmoving and landscaping. Wherever feasible and cost effective, gardens shall be created by these means.

3)                  Only when these possibilities have been exhausted, and where there remains uncompensated garden land ,then ,LHDA shall offer compensation for the loss of garden production in the form of an annual cash payment or lump sum

Sec. 13.1       Vulnerable Households/Malapa a Tlokotsing

 

1)     1) LHDA shall identify and register all Vulnerable Households.

2)     LHDA shall establish a minimum household income threshold below, which no Vulnerable Household’s income shall fall. Shortfalls in household income shall be made up to the level of the threshold for a maximum period of 10 years.  The top-up payment shall be the difference between the threshold amount and the household’s income.

3)     These Vulnerable Households shall receive individual attention of LHDA's staff, possibly assisted by NGO's, to ensure that they are enabled to retain and where possible improve upon the standard of living they enjoyed before the project affected them.

3.REFINEMENTS ON THE PROCEDURES

 

Sec 12.1          Vulnerable Households/Malapa a Tlokotsing

 

Where feasible, and especially in the case of vulnerable groups and individuals, affected parties shall be relocated over the shortest distance possible and within the same chiefdom.

The criteria for a Vulnerable Household shall be the one that is:

1.           Resettled/Relocated

2.           Eligible for Minimum Threshold

 

                        And

 

They must meet one or all of the following criteria:

 

·   The head of the household is over the age of 60 years.

·   The head of the household is ill or disabled.

·   Any of the children resident in the homestead show signs of clinical malnutrition.

·   The legal head of the household is female.

          Special assistance to vulnerable households will take the form of:

 

-  Allowing them first priority in site selection in the host area.

  Attempting, where feasible, to locate them near kin and old neighbors.

- Arranging for contractor-build if they are agreeable.

- Assistance with dismantling of salvageable materials.

- Assistance in preparing a vegetable garden.

-   Monitoring of nutritional and health status.

-   Annual Monitoring to determine whether top-up payment is still applicable given changes in the level of income and standard of living.

-   Training for income restoration and assistance in exploiting the economic opportunities provided by the project.

-   Ho hlahloba malapa ana selemo le selemo ho bona hore na Phahamiso e ntse e hlokahala na; ka mohlomong maemo le chelete ea boipheliso e tla be e fetohile.

-   Ho ba fa koetliso ea ho ikenyetsa chelete le ho sebelisa menyetla e hlahang ka baka la ts’ebetso ea Morero.

 

Sec. 12.2 Disturbance Allowance/ Chelete ea Phalliso e fuoang Bafalli

 

   Each Household under the resettlement programme shall be paid disturbance allowance decreasing annually to zero over a period of three years from the date of arrival at the resettlement or relocation destination.

An annual top-up amount will be made to the level of minimum threshold for a maximum period of 10 years as shall be determined from periodic assessment of household's annual income..

4.REFINEMENTS ON THE RATES

 

Sec 1.2  Gardens/ Majarete

 

Each family moving to a destination where garden land has not been fully compensated in-kind will receive compensation for the garden lost production, at the rate of M 3.00 per sq. Per year for 50 years or M 61.95 per sq. as a lump sum.

A top-up payment to the minimum threshold of M 3, 960 per annum will be paid to Vulnerable Households to the maximum period of 10 years.. The annual amount payable to the resettled households will be the top-up amount calculated as the difference between M3, 960 and the household annual income.
